This Privacy Policy explains how NEBBIA, s. r. o. (“NEBBIA,” “we,” “us,” or “our“) collects, uses, discloses, and protects personal information when you visit https://nebbia.fitness/ (the “Site“), shop with us, create an account, sign up for our emails, or otherwise interact with us. It also explains the privacy rights available to you and how to use them.

NEBBIA is a fitness apparel brand headquartered in Slovakia. We decide how and why your personal information is processed.


2. Personal Information We Collect

“Personal information” means information that identifies, relates to, or could reasonably be linked with you or your household. The table below lists the categories of personal information we have collected in the preceding 12 months, and whether we have sold or shared each category (see Section 7 for what “sold” and “shared” mean).

We use sensitive personal information only to provide and secure your account and for other purposes permitted by law. We do not use it to infer characteristics about you, and we do not sell or share it.

We do not intentionally collect biometric information, precise geolocation, health information, or information about protected characteristics such as race, religion, or sexual orientation.


3. Where We Get Personal Information

  • Directly from you, when you place an order, create an account, sign up for emails, submit a return or warranty claim, or contact customer service.
  • Automatically from your device, through cookies, pixels, and similar technologies when you use the Site (see Section 5).
  • From service providers and partners, such as payment processors confirming a transaction, shipping carriers providing delivery status, and advertising and analytics partners.

4. How We Use Personal Information

Processing orders. We use your name, address, phone number, email address, and payment information to take your order, process payment, ship your products, send order and shipping updates, and handle any follow-up.

Your account. If you create an account, we use your email address and password to let you log in, reset a forgotten password, save your details for faster checkout, and show your order history.

Returns, exchanges, and warranty claims. We use your contact details, order or invoice number, information about the product and the issue, and (where needed for a refund) payment or bank account details to handle your request.

Customer service. We use the information you give us to respond to your questions and requests.

Email marketing. If you sign up for our newsletter, we use your email address to send you news, product launches, and offers. If you have bought from us before, we may also send you marketing emails about similar products. You can unsubscribe at any time using the link in any marketing email. Unsubscribing from marketing does not stop order-related emails.

Analytics and improving the Site. We use information about how visitors use the Site, including session recordings, to measure traffic, fix problems, and improve how the Site works.

Advertising. We use cookies and pixels to show you NEBBIA ads on other websites and apps and to measure how well our ads perform. You can opt out as described in Section 7.

Security and fraud prevention. We use personal information to protect the Site, our customers, and NEBBIA from fraud, abuse, and security incidents.

Legal, tax, and accounting obligations. We keep invoices and accounting records as required by the laws that apply to us, including Slovak tax and accounting laws, and we respond to lawful requests from authorities.

We do not use automated decision-making or profiling that produces legal or similarly significant effects about you.


5. Cookies, Pixels, and Session Recording

We use the following types of cookies and similar technologies:

  • Strictly necessary cookies keep the Site working, for example your shopping cart, login session, and security features. They cannot be turned off.
  • Analytics cookies tell us how many people visit the Site, where they come from, and how they use it. We use Google Analytics and Microsoft Clarity. Microsoft Clarity records how visitors interact with pages (such as clicks, mouse movements, and scrolling) to help us improve the Site.
  • Advertising cookies and pixels let us and our advertising partners, including Google (including DoubleClick) and Meta (Facebook and Instagram), show you relevant ads and measure ad performance.
  • Embedded content from YouTube and Vimeo may set cookies when you play a video.

When you visit the Site, our servers also automatically log technical information sent by your browser, such as your IP address, the date and time of access, the page requested, the referring website, your browser and operating system, and your internet service provider.

Session cookies are deleted when you close your browser. Other cookies remain on your device until they expire, for no longer than 13 months, or until you delete them. You can manage your preferences at any time through our https://nebbia.fitness/cookies/ and can delete cookies through your browser settings. Blocking some cookies may affect how the Site works.


6. How We Disclose Personal Information

Service providers. We disclose personal information to companies that perform services for us under contracts that restrict how they may use it. In the preceding 12 months, we disclosed identifiers, customer records, commercial information, and internet activity information for business purposes to:

  • Website hosting: DigitalOcean, LLC (United States)
  • Email marketing: Brevo (Sendinblue SAS, France)
  • Accounting: MONESTI, s.r.o. (Slovakia)
  • Payment processing: Stripe, PayPal, Apple Pay
  • Shipping and fulfillment: FedEx
  • Analytics: Google, Microsoft (Clarity)

Advertising partners. We make identifiers, commercial information, internet activity, approximate geolocation, and inferences available to advertising partners, including Google and Meta, through cookies and pixels on our Site. Under some state laws this may count as a “sale” or “sharing” of personal information or as “targeted advertising.” See Section 7 for how to opt out.

Legal and safety reasons. We may disclose personal information to government authorities, courts, tax authorities, or others when required by law, or when we believe disclosure is needed to protect our rights, our customers, or the public.

Business transfers. If NEBBIA is involved in a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to this Privacy Policy.

With your direction. We disclose personal information when you ask us to or give us permission.

We do not publish your personal information.


7. Sale, Sharing, and Targeted Advertising

We do not sell personal information for money. However, some US state laws define “sale,” “sharing,” and “targeted advertising” broadly enough to include allowing advertising partners to collect information through cookies and pixels on our Site. For that reason, we treat this activity as a sale or sharing and give you the right to opt out.

How to opt out:

  • Turn on Global Privacy Control (GPC) in a browser or extension that supports it. We treat a GPC signal as a valid request to opt out of the sale and sharing of personal information and targeted advertising for that browser, and, if you are logged in, for your account.

You do not need to create an account to opt out.

Do Not Track. Our Site does not respond to “Do Not Track” browser signals, because there is no common industry standard for them. We do honor Global Privacy Control as described above.

We do not knowingly sell or share the personal information of consumers under 18.


8. Your Privacy Rights

Depending on where you live, you may have some or all of the following rights. We extend these rights to all US residents.

  • Right to know and access: request the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties to whom we disclosed it.
  • Right to correct: ask us to correct inaccurate personal information.
  • Right to delete: ask us to delete personal information we collected from you, subject to legal exceptions (for example, records we must keep for tax purposes).
  • Right to data portability: receive your personal information in a portable, commonly used format.
  • Right to opt out of the sale or sharing of personal information, targeted advertising, and profiling that produces legal or similarly significant effects (see Section 7).
  • Right to a list of third parties: request a list of the specific third parties to which we have disclosed personal information.
  • Right to non-discrimination: we will not deny you goods or services, charge you different prices, or give you a lower quality of service because you exercised your privacy rights.

How to submit a request. Email [email protected] . Please tell us which right you want to exercise and the email address you use with NEBBIA.

Verification. To protect your information, we will verify your identity before responding to requests to know, access, correct, or delete, usually by matching information you provide (such as your email address and an order number) with information we already have. We do not require verification for opt-out requests.

Authorized agents. You may use an authorized agent to submit a request on your behalf. We may ask for written proof that the agent is authorized and may ask you to verify your identity directly with us.

Response time. We will respond within 45 days of receiving your request. If we need more time, we will tell you and may extend this period as permitted by law.

Appeals. If we decline to act on your request, you may appeal by replying to our decision or emailing [email protected] with the subject line “Privacy Request Appeal.” We will respond to your appeal within the time required by applicable law and explain our decision. If your appeal is denied, you may contact your state Attorney General.


9. How Long We Keep Personal Information

We keep personal information only as long as needed for the purposes described in this policy, unless a longer period is required by law.

NEBBIA is based in Slovakia. Your personal information will be processed in the European Union and in the United States, and may be processed in other countries where our service providers operate. We take reasonable steps to make sure your personal information is protected wherever it is processed.


11. How We Protect Personal Information

We use reasonable technical, administrative, and physical safeguards designed to protect personal information, including access controls, encryption, staff confidentiality obligations, and internal security policies. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.


12. Children and Teens

Our Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us personal information, please contact us at [email protected] and we will delete it. We do not knowingly sell or share personal information of, or engage in targeted advertising to, anyone under 18.


13. Artificial Intelligence

We do not collect, use, or sell personal information to train large language models.


14. Additional State Disclosures

California “Shine the Light.” California residents may request information about our disclosure of personal information to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

Nevada. Nevada residents may submit a request directing us not to sell their covered information by emailing [email protected].
